Having received a certificate confirming his right to own a trademark, an entrepreneur can safely sue at the signs of illegal copying. The protection of such a right begins from the moment of filing the application, which is very important, since the term for its consideration reaches one year.

The first step in registering a trademark is to create it directly. It is composed in color and contains a drawing or an alphanumeric designation, or both together. The image should not be an advertisement for the quality of the product or repeat its appearance. Many brands have already been patented, so that complete duplication or partial similarity with existing logos does not cause a return of the application, you need to search the database of Rospatent, while its objects are not only Russian, but also international emblems.

Having received the search results and adjusted your trademark if necessary, you can start writing an application and sending it directly to the Federal Service or by fax with the subsequent submission of the original. Such haste is sometimes useful when you urgently need to secure your rights to the logo.

The application should contain a clear description of the trademark, indicating its structural features and their meaning, decoding of abbreviations and transliteration of the Latin alphabet. Next is written a numerical category of products and their description. So, clothing belongs to class 25. The document must contain a complete image of the brand, and if it is voluminous, then in three projections.

Six additional cards with an emblem duplicated in the dimensions of 8 * 8 cm and a receipt of payment of state duty are attached to the application. After a long wait, a letter arrives with the result, and if it is positive, then you must pay another fee for issuing a certificate. A trademark patent is valid for 10 years. A year before the end of the line it needs to be extended.
