How to open an educational institution

Educational activities in Russia are conducted on the basis of the law "On Education". This document does not contain an unambiguous and specific definition of activities in the field of education, but in a general sense, educational activities are understood to mean activities as a result of which students receive knowledge, skills, abilities, and vocational training in their chosen specialty. But in order to open an educational institution, it is not enough to be a good teacher.

Determine what the legal form of the future educational institution will be. Such activities are legally entitled to carry out legal entities (non-profit organizations) or individuals registered as individual entrepreneurs. Commercial organizations cannot conduct educational activities.

Understand educational licensing issues. In most cases, obtaining a license will be a mandatory step in creating an institution. An exception is individual pedagogical activity carried out by an individual entrepreneur - it does not require a license. In other cases, conducting this type of activity without a license entails criminal liability. If you plan to conduct seminars, trainings, lectures, and provide consulting services without issuing diplomas, certificates or certificates of education, a license is also not required.

Define the circle of founders of the educational institution. These may be bodies of state power, local self-government, organizations of any form of ownership, citizens of Russia or other states.

Prepare the charter of the educational institution. As a basis, you can take ready-made constituent documents of the existing organization carrying out the educational process. If you want to get a quality document, entrust the compilation of the charter to a qualified lawyer, having prepared your personal wishes regarding certain sections.

After preparing the documents, register the institution with the authorities of the Federal Registration Service. If you have chosen a consumer cooperative as the legal form, tax authorities will register it.

After registering the educational institution, put it on tax accounting and on the account in extra-budgetary funds, as well as in state statistics.

After registration and registration for the appropriate types of accounts receive an educational license. Licensing is carried out by the Ministry of Education and local authorities.

After obtaining a license, you can begin the direct implementation of activities, guided by pre-designed training plans and educational programs. After three years of work, the institution has the right to receive state certification and then apply for its state accreditation. From the moment of accreditation, you will have the right to issue state-certified documents on qualifications and the level of education received to persons who have passed the final certification.
