How to rent a forest

By law, citizens and legal entities are entitled to lease forest plots. To do this, you need to participate in the auction for the sale of the right to conclude a lease agreement for a forest plot and subsequently conclude a lease agreement for such a plot with an authorized body. In some cases, the forest can be rented without auction.

Make sure you must bid for a forest plot. According to part 3 of article 74 of the Forest Code, in some cases it can be done without an auction. These are the following cases:

1. For hunting.

2. For geological exploration.

3. For the development of mineral deposits.

4. For the operation of water bodies.

5. For the construction of linear facilities.

6. For the implementation of priority investment projects.

7. For timber harvesting for the purposes specified in paragraphs 2-5 above.

In this case, contact the authorized state and municipal authority to conclude a lease.

In all other cases, you must participate in the auction for the sale of the right to conclude a lease agreement for a forest plot. To do this, you must submit an application for participation in the auction to an authorized state or municipal body, indicating in it information about yourself (or a legal entity). In addition, you will need to make a deposit and provide a receipt about it. The state or municipal authority responsible for the auctions prepares the necessary documentation and notifies the public of the auction (usually through the media and the official website of the authority). In a certain period established by these bodies, other persons are also entitled to submit their applications. Upon completion of their admission, an auction is held. If there are no applications besides yours, then the authority is obliged to conclude a lease agreement for the forest plot with you.

A forest plot lease agreement is concluded with the winner of the auction within 10 business days from the date of signing the auction protocol. It is prepared by the authorized body in the form approved by the Government of the Russian Federation. The same authority calculates the rent for the plot and reflects it in the contract. Its minimum size is defined as the product of the rate of payment per unit area of ​​the site and its area. Rates are set by the government.
