How to suspend an enterprise

Suspension of the enterprise by the norms of federal and tax Russian legislation is not provided. In fact, an inactive organization is obliged to report to the tax inspectorate by submitting zero returns.

If you decide to suspend the company for an indefinite period, you need to fire the staff of the company. It is possible to carry out this procedure only with the consent of the workers. Ask them to write a statement of their own free will. If employees compromise, then terminate the employment relationship by agreement of the parties.

If specialists refuse to write a letter of resignation, then you can cut staff. Employee consent is not required. Make a staff reduction order. The reason for the publication of the document may be a change in organizational, technological working conditions. Notify each employee individually about such an event in the form of notifications. Hand them over to specialists two months before the actual date of job cuts.

Send information about the upcoming staff reductions to the employment center two months before this procedure.

After two months, make a note of the reduction in the employment records of employees. Give them the money they owe, pay severance pay so as not to violate labor laws.

If the company has one founder, who is the general director and chief accountant, then the sole participant sends himself on vacation at his own expense for an indefinite period. Moreover, he is not exempt from reporting. A zero balance, zero return should be submitted to the tax authority. It is provided by the Tax Code of the Russian Federation.

If the company has several participants, then the director and chief accountant should be relieved of their posts. One of the founders of the company is appointed to the place of the leader, who also goes on vacation without maintenance, but the reports are submitted on time.

The best way to suspend an enterprise is to liquidate it. So you will not have problems with the tax office, employees. At any time, you have the right to create a new company and carry out activities from a new legal entity.
