How to refuse to return a product

The relationship between the seller of the product and its buyer is regulated by the Civil Code of the Russian Federation and the Federal Law "On Protection of Consumer Rights". However, this law stipulates not only the rights of the buyer, but also the seller, who also has the opportunity in some cases to refuse to return the goods.

The condition for the return of goods of good quality is compliance with a 14-day period, not counting the day of purchase of the goods. But such an excuse as “disagreeing” or “changed his mind” does not work here. By law, you must exchange goods that did not suit the buyer in size, style, size or configuration. So, for example, if the store has the same product of a different size, you may well refuse to refund the money paid.

For a negative decision regarding return, according to Art. 25 of the law, it may become that the presentation of the returned product or its factory packaging is violated. In the event that the goods were in use, there are no factory labels and seals, you also cannot satisfy the buyer's demand for the return of the goods.

In addition, there is a list of goods of good quality that are not subject to return or exchange in any case. In addition to personal hygiene items, underwear, medicines, etc., it includes some types of technically complex household goods. These are those for which the warranty period is established. You will have to return the money if the buyer succeeds in proving that it is impossible to use the goods, and its repair took a total of more than 30 days during the year of operation.

Study Art. 18 and 19 of the Law, in them you will familiarize yourself with the rights of the consumer when a marriage is discovered in the product and the terms during which these rights can be claimed. An elementary violation of such terms may already serve as the legal right to refuse to return the goods.

You can also leave the buyer’s requirements unsatisfied if the rules for the operation or care of the product have been violated. For example, a thing was washed, while only dry cleaning was recommended.

Keep in mind that not a single legal act establishes the obligation of the buyer to store consumer packaging of the purchased goods. Your refusal to voluntarily return the money on this basis will be easily challenged in court.
