How to determine the code

The HS code is a universal method for classifying goods transported through customs. This cipher code consists of ten digits, each of which is important because it describes the product, the group to which it belongs, the material from which it is made, and other data. The definition of the HS code is an important operation, on which the success of an activity largely depends.

You will need

• - export declaration of the seller;

• - Commodity Nomenclature of Foreign Economic Activities;

• - normative documents;

• - agreement with a customs broker.

Ask the seller of the goods which HS code is listed in his export declaration. If the international system of HS operates in the country of the manufacturer from whom you purchase the goods, then the first six digits of the HS code for the goods you import must match. In practice, you may encounter a situation where the seller does not declare the exported goods or the customs inspectors simply do not agree with the specified code.

Try to figure out the principles of product classification on your own and determine the HS code. Carefully study the Commodity Nomenclature of Foreign Economic Activities: it has a tree structure, the top of which is "Sections". Each section title characterizes the industry that produces the goods or products you import. The following are “Groups”, formed taking into account the raw materials from which the goods are made, the degree of product processing, as well as the functionality of the products. Then, “Commodity Items” are presented, followed by “Commodity Subheadings” and the subsequent detailed classification. The “Notes”, which contain the “Sections” and “Groups”, will significantly help you: they indicate which products can be assigned to this category and which not.

Get a classification decision from the Federal Customs Service. Your right to obtain this official permission is regulated by at least two regulatory documents: Order of the Federal Customs Service of the Russian Federation No. 951 dated 01.08. 2008, as well as the Order of the State Customs Committee of the Russian Federation No. 388 dated April 23. 2001

Use the services of a customs broker who will enter the HS code in the customs declaration. Be sure to conclude a contract with this person who stipulates liability for the incorrect classification of the goods.
