In order to rent a store, you need to understand how business organization will be implemented. Will it be a legal entity registered in the manner prescribed by law, or will commercial activities be carried out by an individual entrepreneur. For the rental of commercial premises, it is necessary to request legal and supporting documents from the owner of non-residential premises. These include: a contract of sale, donation, equity in construction, documents on privatization or inheritance, a certificate of ownership, as well as a cadastral and technical passport, an extract from the register of rights to real estate.

The lessee and the lessor can be both individuals and legal entities. To conclude a contract, an individual is required to have a passport. If the party to the contract is a legal entity, then the package of documents for concluding a lease agreement is significantly increased. The organization must provide: a charter, amendments thereto, certificates of state registration of a legal entity and registration with a tax authority; information letter from the statistical office with the types of economic activity; extract from the unified state register of legal entities; protocol for the appointment of the head of the organization.

After the lease agreement is concluded, the tenant must receive the documents of the supervisory authorities: the conclusion of the State Fire Inspection (on the fire safety of the premises); conclusion of Rospotrebnadzor (on the sanitary and epidemiological condition of the premises). You also need to buy and register a cash register; obtain a license in cases provided for by the legislation of the Russian Federation; obtain permission to advertise with the district or city administration and produce an ad slot passport.

A non-residential premises lease agreement is concluded only in writing, if the term of the agreement exceeds one year, then it is subject to state registration with the Federal Register of Regions. If the premises are subleased, it is mandatory to obtain the consent of the owner to sublet the premises, unless otherwise provided by law or contract. It is necessary to clarify with the owner of the object the existence of concluded agreements with organizations that supply utility services.
