How to put the object into operation

In order to put the completed capital construction project into operation, you must obtain permission to put this object into operation. Such permission will allow to put the object on the state account. The algorithm for obtaining this permission is governed by Article 55 of the Town Planning Code of the Russian Federation.

A permit for putting a capital construction object into operation is a document on the construction, reconstruction or overhaul of a capital construction object in accordance with a building permit, urban development plan of a land plot and design documentation. It should be noted that the commissioning permit (as well as the construction permit) is obtained only during the construction of the capital construction facility, i.e. buildings, structures and structures, but not pavilions, stalls, etc. The developer receives such permission in the bodies of federal executive power, authorities of subjects of the federation or local self-government, which are authorized to issue such permits. The permission form for putting the facility into operation is established by the Ministry of Regional Development of the Russian Federation.

You can get permission to put the facility into operation by drawing up an application for such permission and attaching the following package of documents to it:

1. documents of land rights (land lease agreement, etc.);

2. permission to build this facility;

3. acceptance certificate of the facility (required if the construction was carried out on the basis of the contract);

4. documents on the compliance of the facility with technical regulations, design documentation, technical conditions;

5. urban development plan of the land;

6. scheme of the facility with the display of networks of engineering and technical support.

In some cases, the conclusion of state construction supervision authorities may also be necessary.

Authorities issuing permits for putting objects into operation are entitled to refuse an applicant if:

1. not submitted all the necessary documents;

2. the object does not meet the requirements of a building permit, urban development plan of a land plot, design documentation.

The applicant has the right to challenge the refusal to issue a building permit in court.
