How to register a law office

According to the legislation of the Russian Federation, a lawyer's office can be registered only by a person with a higher legal education, at least two years of professional experience in the specialty and who has received the status of a lawyer.

To obtain the status of a lawyer, pass the qualification exam, which is organized by the Council of the Federal Chamber of Lawyers. The level of vocational training of the applicant is checked on the basis of his written answers to questions, as well as in the process of an oral interview. Successful passing of the qualification exam is followed by an oath. In case of failure, re-examination procedure can be completed only after a year.

After assigning you the status of a lawyer, get a certificate. The Qualification Commission will notify the territorial justice authority of the exam result within seven days. The latter will enter information about you as a lawyer in the regional registry and issue a certificate confirming your status and containing your name, first name, patronymic, registration number in the registry.

After receiving the certificate, within 6 months, notify the council of the bar of law about the establishment of a cabinet. The notice is issued in writing in free form and sent by registered letter. It contains information about the founder (name, registration number), the location of the office with the exact postal address (including its name) and how the council communicates with the lawyer.

According to the "Federal Law on Advocacy and the Bar", the law office is an organizational form of individual activity, and not a legal entity. However, the lawyer must open a bank account and have a stamp indicating the name of the law office and its address. Registered in the tax authorities is not the law office, but the lawyer as a taxpayer. At the same time, he has the right to carry out his professional activities only in this institution.
