The tax code of the Russian Federation gives the payer of personal income tax (income tax for individuals, in common terms - income) the right to four deductions: standard, property, social and professional. This is the name of the part of the income that you do not have to pay tax on. And if it has already been paid, the state will return it. But for this it is necessary to complete a number of formalities.

A prerequisite for providing a deduction is your submission of a declaration in the form of 3NDFL. If you receive income from tax agents, it doesn’t matter only at the place of main work or somewhere else, or you don’t have a main place of work at all, but the tax on your income is withheld by someone who pays you for one reason or another, you don’t declare your income should.

But if you claim a deduction, you have to do it.

But before filling out the declaration, collect documentary evidence of your income and payment of tax on it. You will receive 2NDFL certificates from your tax agents. To do this, you must contact the appropriate organization with a statement addressed to its head.

If you have to pay the tax on some income yourself, it will be confirmed by the agreement on the basis of which it was received, and by paying the tax - receipts and checks from the bank with its mark.

The set of documents confirming the right to deduction depends on which one of the possible you are applying for.

For example, to deduct a minor’s parents, a child’s birth certificate is required, for educational costs - an educational services agreement, an institution’s license to provide them and payment receipts, for a property deduction - a certificate of ownership of the sold housing, car, etc.

You must also write a deduction statement.

There is no strict form, but it is necessary to indicate where it is addressed, who submits it, where it is registered, how to contact it, and which particular deduction it claims.

It is also advisable to indicate the amount of the deduction, the amount of tax to be returned, the form of provision: through a tax agent or by transferring the tax to be returned to the account at the Savings Bank (it is better to indicate all the details for payment directly in the application).

Take the finished set of documents to the tax office (with a copy on which you will mark the acceptance) or send it there by registered mail with a list of investments and a notification of delivery.

If you prefer to receive a deduction through a tax agent, the inspectorate will give you a certificate that you need to include in accounting, and it will cease to withhold personal income tax from you until the state pays you, but no longer than a year. If on a bank account, wait for the transfer.

If the tax deduction is 100 thousand rubles, this does not mean that you should be returned this amount. We are only talking about the tax that you paid from it, that is, 13 thousand rubles.

No matter how much you are supposed to as a deduction, you will not receive back the amount of tax more than you paid during the year.

Useful advice

The 2NDF declaration for the last year should be filed with your territorial tax inspectorate from January 1 to April 30.

If you did not manage to collect all the documents before the deadline for submission, anyway, file a declaration. In this case, you can convey the rest within three years from the day when you sent this document by mail or taken to the inspection. Just do not forget to submit an updated declaration.
