How to open a nonprofit organization

For those who want to engage in charity, cultural enlightenment, education, and other activities that do not have a profit as their main goal, you can open a non-profit organization. For its opening, it will be necessary to develop a package of constituent documents and register it with the territorial bodies of the Ministry of Justice.

Decide for what purpose you are going to open a nonprofit organization. Its name and type depend on the nature of the activity that it conducts. Remember that the list of types of non-profit organizations referred to in the Federal Law "On Non-Profit Organizations" is open, therefore, you have the right to open an organization of a different type not specified in the law.

Depending on the type of non-profit organization, develop its constituent documents. This can be done both independently and by entrusting a law firm. About what constituent documents are necessary for some types of nonprofit organizations can be found in the Federal Law "On Nonprofit Organizations" (Chapter 2).

No later than within three months from the date of the decision to create a non-profit organization, you must submit to the territorial body of the Ministry of Justice the following documents for its registration:
1. application for registration;
2. constituent documents (3 copies);
3. The decision to create an organization;
4. documents of founders (2 copies);
5. receipt of payment of the state registration fee;
6. Information about the address of the organization.
In certain cases, other documents specified in law may be required of you.

After submitting the documents you need to wait 14 days - during this time the authorized body will decide on the possibility of registering your non-profit organization. If the decision is positive, within five days the body of information and documents necessary to carry out the functions of maintaining the Unified State Register of Legal Entities (USRLE) are sent to the tax inspectorate. Within three days, the tax must issue you a certificate of state registration. From the date indicated in the certificate, a non-profit organization can be considered open.
