How to register a company at your address

Registration of the company at the home address of one of the founders or the head is quite convenient: it ensures that all mail correspondence from tax and other bodies reaches the recipient. In addition, there is no need to rent a separate post office box at the post office. Nevertheless, the registration of a company to its address has some peculiarities.

Basically, there are no obstacles to registering an enterprise at the home address of the head or one of the founders (individuals). To do this, you need to attach to the standard package of documents for registration of the company a letter of guarantee from the homeowner in which he agrees to provide you with a certain area.

If you yourself are the owner of the housing, attach a copy of the certificate of registration of ownership of the premises to the letter of guarantee. In the event that you are not the owner of the housing, but only registered in the apartment, attach (in addition to a copy of the certificate) a letter from the owner stating that he does not mind registering the company at this address.

In a situation where you are not the owner and are not registered in the apartment for which you want to register a company, but only rent a house under a social contract of employment, enclose a letter in which all persons registered in the premises agree to be registered at this address entity.

Despite the fact that the registration of the company at home is possible, the tax authority can still refuse you, and such a refusal will be legal. The fact is that article 288 of the Civil Code of the Russian Federation stipulates that placement in residential premises of enterprises is allowed only if they are transferred from a non-residential housing stock. Also, the law prohibits the placement of industrial production in residential premises.

If you want to change the legal address of an already registered and functioning company, fill out form P13001, prepare a protocol or decision to change the address, a new edition of the charter, a request for a copy of the charter. Attach the receipt of payment of the state duty with the bank mark to the package of documents. Submit the listed documents to the territorial tax authority within three days from the date of the decision.
